Terms of Service

Welcome to Pickmix. These Terms of Service ("Terms") govern your access to and use of the Pickmix platform, including our website, browser extension, and related services (collectively, the "Service"), operated by Pickmix ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly collect data from children under 13.

2. Account Registration

To access certain features, you must create an account using Google Sign-In or another supported authentication method. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

3. Your Content

You retain all ownership rights in the content you submit, upload, or store through the Service ("Your Content"), including notes, links, files, and any other materials. By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely for the purpose of operating and improving the Service.

You represent that you have all necessary rights to submit Your Content and that it does not violate any third-party rights or applicable laws.

4. AI-Generated Output

The Service uses artificial intelligence to process, organize, tag, summarize, and enhance Your Content ("AI Output"). You own the AI Output generated from Your Content to the extent permitted by applicable law. We do not claim ownership of AI Output.

AI Output is provided on an "as is" basis. AI-generated content may be inaccurate, incomplete, or misleading. You are solely responsible for reviewing, verifying, and deciding how to use any AI Output. Do not rely on AI Output for medical, legal, financial, or other professional advice.

5. Data Usage and Model Training

We do not use Your Content to train general-purpose AI models. Your Content is processed solely to provide the Service to you. Aggregated, anonymized usage data (such as feature usage patterns) may be used to improve the Service. See our Privacy Policy for details.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
  • Upload or transmit malware, viruses, or any harmful code;
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Use the Service to generate spam, phishing content, or misleading materials;
  • Scrape, crawl, or use automated means to access the Service without our written consent;
  • Interfere with or disrupt the integrity or performance of the Service.

7. Subscription and Payments

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. We reserve the right to change pricing with 30 days' prior notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Termination

You may terminate your account at any time by contacting us at [email protected]. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. We will make Your Content available for export for 30 days following termination, after which it may be permanently deleted.

9. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is owned by Pickmix and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKMIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold harmless Pickmix, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in English. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

14. International Users

If you access the Service from outside the United States, you are responsible for compliance with local laws. For users in the European Economic Area (EEA), United Kingdom, or Switzerland, nothing in these Terms affects your statutory rights under applicable consumer protection laws. Where these Terms conflict with mandatory local laws, those local laws shall prevail.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective date" above. For significant changes, we will provide additional notice (such as email notification). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
